Shipping Policy

We are responsible for your order from placement to production, packaging and getting your order to the shipping carrier. Once your order has been handed over to the shipping carrier, our responsibility ceases.

Hence, any items damaged in shipping must be addressed with the shipping carrier themselves. We are not responsible for any lost or damaged packages during transit after order is placed, confirmed and shipped out by us.

Please include your phone number when you place your order to ensure we can contact you in the event that there is a problem with your order or delivery.

If your order is returned to us due to being undeliverable, a reshipment fee, 100% of the initial shipping charge, will be required.

When applicable, we will provide you with instructions where to send returned goods. We strongly recommend that you get proof of postage when returning goods to avoid "lost packages" situations. Please note that customers are responsible for shipping costs of returned items when required.

 

SHIPMENT TRACKING NUMBERS

Primarily, we ship with USPS and we will email you your USPS shipment tracking number so you can follow the status of your delivery. Occasionally, we use UPS, DHL, or FedEx for shipping services. If you have a shipping carrier preference, please email us at support@TheKochPro.com immediately after you place your order.

 

Shipping options

We offer Next Day Shipping, 2nd Day Shipping, 3 Day Shipping and Regular Ground Shipping.

Regular ground shipping orders approximately take 4 to 10 business days or sooner.

 

We, KōchPro LLC also known as KōchPro absolutely do not offer refunds after your order status with the mailing carrier is “marked” as delivered. It is your responsibility to keep track of your package with the shipment tracking number that we have provided you. Make sure you provide a correct and valid email address so you may receive your tracking number. Also, always make sure your shipping address is valid and correct for accurate delivery by the mail carrier.

 

Once we ship your order you must contact the shipping carrier that we used for your package concerns, which will be one from the following list: USPS, UPS, FEDEX, DHL or your local carrier in your region. You may contact us by email at support@thekochpro.com for your mailing carrier’s office number. Again, we will always provide you with your tracking number. You may also conduct an internet search for your mailing carrier’s customer service phone number using the tracking number that we have provided you.. We will always have evidence of the status of your package.

 

Shipment tracking numbers are not available until production is completed. You may be able to track your order with the carrier provided.

TURNAROUND TIMES

Standard devices are shipped within 3-5 days of confirmed purchase and depend on the shipping option you select.

Custom devices are shipped postproduction process. The production time frame depends on your purchase order and time frames will be provided to you at the time of purchase.

In the event that we are unable to complete production within the specified time frame, we will accommodate for the additional time spent on production with a faster shipping method so that you can still receive your order on or around the estimated delivery date.

Please keep in mind that we do not guarantee delivery dates, the date you are provided with is simply an estimate.

Warranty

If you are not entirely satisfied with your purchase, we’re here to help.

 

This refund and return policy explains how we manage refunds, returns and describes our warranty.

Returns & Cancellations

Returns

We DO NOT accept returns.

 

To be eligible for a refund, we require a proof of purchase in the form of your order number and you must cancel your order before your device(s) are shipped.

 

Cancellations

To request a cancellation, please email support@TheKochpro.com. Please include your order number and place “request a cancellation” in the subject line. Any cancellation requests received after the order has been shipped will not be eligible for a refund. If you qualify for a cancellation, a valid cancellation confirmation email will be sent confirming that your order has been cancelled, after which a full refund will be provided.

KōchProÔ will only be able to process refunds after a valid cancellation confirmation.

Refunds are available if applicable.

 

If your KōchProÔ device is damaged, meaning your device is scratched or bent; you may be eligible for a replacement. We offer replacements for damaged devices with photo proof within 48 hours of delivery. You may be required to ship the damaged device to us.

 

If your KōchProÔ device is defected, meaning you are having trouble programming your device or your device is not working after it has been programmed, you may be eligible for a replacement or refund. Typically, all issues can be resolved with guidance from our support team.

 

In the unfortunate event your device is defected due to software malfunction or our support team cannot help resolve your issue and you would like to request a refund or replacement, please email our support team at support@TheKochPro.com. Due to the fact that we test each device before shipping, you may be required to ship the defected device to us for inspection to determine your refund eligibility. Once approved for a refund, we will send you an email notifying you that we have refunded your purchase. Your refund will then be processed, and a credit will automatically be applied to the original method of payment, within 2-7 days.

 

KōchProÔ devices that are adhesive and does not adhere well to a case or phone qualifies you for a replacement device, not a refund. You may be required to ship the device to us.

 

CUSTOM Devices

Our Custom devices are eligible for full refunds on the basis that you request a cancellation request within 1-2 days after purchase. Any cancellation requests received after this period will not be eligible for a refund.

 

Custom Replacement POLICY

If you purchased a custom device or card and the quality does not satisfy you, please inform us via email and provide pictures of the custom device or card to hello@thekochpro.com. Please describe what you consider deficient, so we may advise and make changes where necessary. We may require you to return the device or card for inspection. Please only mail the device or card if a member from our support department asks you via email to do so.

Any error on us in production or if you received anything different from the approved proof; we will provide you with a replacement at no additional cost. 

However, we cannot be held responsible for customer errors.

 

 

Warranty

 

Non-Adhesive Devices

All KōchProÔ devices purchased directly from us come with 90-day Limited Warranty. During the limited warranty period, we will repair or replace any defective product, for the original purchaser. Warranty is not transferrable, and requires the product to be returned to us at the customer's expense. Warranty covers any defects in software, and is limited to one full replacement device for each device purchased, for the original purchaser.

To file a warranty claim, please email us at support@thekochpro.com, with your order number, contact information, a description of the problem and write “warranty” in subject line.. We will respond within 24 hours with a repair or replacement solution. We reserve the right to replace with a refurbished product, or substitute with a comparable device, or with a different color, or refund the original purchase price. If the warranty claim is within 30 days of purchase date, we will pay for ground shipping both ways. After 30 days, the customer is responsible for all shipping costs associated with the warranty service. In case a defective device is not required to be returned, the customer pays outbound shipping of the warranty device.

Normal wear and tear including but not limited to scratches, scuffs, dents, and accidents are not covered by our Warranty. Excessive force and mis-use are not covered. A “Locked” device by user is not covered. NFC chips can be permanently locked or password protected making whatever information programmed on them permanent and non-rewritable.
 

Adhesive Devices 

 

If your device loses its adhesive within 30 days of your order being marked as delivered, you are eligible for a free placement. 

 

Warranties do not cover normal wear and tear.

 

 

Late or missing refunds (if applicable) 

If you haven’t received a refund after 7 days from the date that you received a valid cancelation email from our support team, first check your bank account again. 

Then contact your credit card company; it may take additional time before your refund is officially posted. 

Next contact your bank. Often times it takes additional processing time before a refund is posted to your bank account.

Sale items

Only regular priced items may be refunded (if applicable), unfortunately sale items cannot be refunded.

KochPro connects devices to digital solutions. KochPro is a tech company that uses technology to provide solutions through smart devices. We provide a suite of technologies through appropriate devices to share information instantly, yield data and provide solutions.

KōchPro cares deeply about the privacy of its visitors and users. To that end, this Privacy Policy (“Privacy Policy”) describes how KōchPro LLC together with its affiliated companies worldwide (“KōchPro”, “we”, “our”, or “us”), collect, use, and share your Personal Information, as well as an explanation of the data rights you may have in that Personal Information. This Privacy Policy applies to all KochPro users, including unregistered visitors, registered users, and software users (collectively, “Users”, “you”, or “your”), and to all KōchPro services, including our websites (including qr.kochpross.com, www.TheKochPro.com  and any of its subdomains, the “Website”), web applications (“KochPro Apps” , “Qr.Kochpross.com” ), mobile applications (“Mobile Apps”), and related services (collectively, the “Services”). This Privacy Policy is not intended to override the terms of any contract you have with us, nor any rights you may have under other applicable data privacy laws.

3.What ‘Personal Information’ do we collect?

3.1. User information: To provide you the Services, we must collect Personal Information relating to an identified or identifiable natural person (“Personal Information”). We collect Personal Information you provide us, from your use of the Services, and from other sources. Here are the types of Personal Information we collect about you:

a. Information you provide us. When you register for our Services, purchase and/or register for our software, become a member, text us, complete a form, use any of our Services; and/or when you contact us directly by any communication channel (e.g., chat box, profile forms, text messages, emails), you may provide us Personal Information, such as name, email address, phone number, payment information (for Users with Paid Services), information you include in your communications with us and with other users on our platform, and Personal Information contained in uploaded documents via our forms (including but not limited to an ID card, driver’s license, portfolio, images, logos, resume, or any document uploaded to our database).  

b. Information we collect when you use the Services. When you visit, download, and/or use any of our Services, we may collect aggregated usage Personal Information, such as Visitors’ and Users’ browsing and ‘click-stream’ activity on the Services, session heatmaps and scrolls, non-identifying Personal Information regarding the Visitor’s or User’s device, operating system, internet browser, screen resolution, language and keyboard settings, internet service provider, referring pages, exit pages, date and time stamps, etc.

c. Account data, such as your username and password that you set to establish an online account with us, social network handles, biographical details, links and descriptions that you add to your profile, interests, preferences, and any other information that you add to your account profile or any documents upload to our database.

d. Profile data, such as your name, email, number, address, website, job title, social media handles, uploaded PDF and image. If you use our software you are subjected to our partner privacy policy, to view their privacy policy please click here.

e. Communications that we exchange, including when you contact us with questions or feedback, through social media, text message, email, online chat box, or any method in which you exchange with others on or through the Service.

f.  Payments and transactional data needed to complete your orders, Requests, Support, or payments on or through the Service (such as payment card information, billing and shipping information, payment processor information). We use third party providers for credit card and ACH payment processing and shipping. If you purchase through TheKochPro.com, you are subjected to our third-party website builder privacy policy, click here to view. If you receive an invoice and are subjected to our third-party invoicing system privacy policy, click here to review. We use a third-party to create our shipping label and email your order tracking information you are subjected to their privacy-policy, click here to review. We use a third-party company for you to make purchases through our text service, you are subjected to their privacy policy, click here to review. If you make a payment through text message, you may be subjected to our third-party text platform, click here to review their privacy policy.

g. Marketing data, such as your preferences for receiving communications about our or our partners’ products, services, activities, and events, and details about how you engage with our communications.

h. Content that you upload or share to the Service, including text, photos, numbers, emails, addresses, documents, links, and videos in connection with Requests, products, digital goods and your profile.

i .Product data, such as the description of a product or digital good for sale, its price, its images, its commission.

j. Other information that we may collect which is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise described at the time of collection.

k. Information we collect from other sources. We may receive Personal Information about you from third-party sources, such as:

  1. Security providers, fraud detection and prevention providers for example to help us screen out users associated with fraud.

  2. Social media platforms, when you log-in or sign-up using your social media account, we may receive Personal Information from that service (e.g., your username, basic profile Personal Information) and in some cases, we may collect Personal Information from lead enhancement companies which help us to improve our service offering.

  3. Advertising and marketing partners in order to monitor, manage and measure our ad campaigns.

  4. Business partners, such as companies that have entered into joint marketing relationships or other joint ventures with us, merchants, and affiliate marketplaces.

3.2. Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, your activity over time on our sites and other online services, and your interactions with our marketing communications such as:

  1. Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and general location information such as city, state or geographic area.

  2. Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.

  4. Data about others. Users of the Service may have the opportunity to refer friends or other contacts to us and share their contact information with us. Please do not refer someone to us or share their contact information with us unless you have their permission to do so.

  5. Users of users ‘Personal Information’ for software / membership: We may also collect Personal Information pertaining to visitors and users of our User’s accounts, profiles or services (“Users-of-Users”), solely for and on our Users’ behalf (as further described in Section ‎6 below).

4. What purposes do we collect such ‘Personal Information’

We use your Personal Information for the following purposes:

 

  1. To provide and operate the Services;

  2. process and track your orders;

  3. facilitate payments;

  4. establish and maintain your user profile on the Service;

  5. enable security features and account management features of the Service, such as by sending you security codes via email, make changes to your account per your request, updating your profile per use request via a profile update form, and remembering devices from which you have previously logged in.

  6. To further develop, customize, expand, and improve our Services, based on Users’ common or personal preferences, experiences and difficulties;

  7. To provide our Users with ongoing customer assistance and technical support;

  8. To be able to contact our Users with general or personalized service-related notices and promotional messages (as further detailed in Section 8 below);

  9. To help us to update, expand and analyze our records to identify new customers;

  10. To facilitate, sponsor, and offer certain contests, events, and promotions, determine participants’ eligibility, monitor performance, contact winners, and grant prizes and benefits; communicate with you about the Service, including by sending announcements and event invitation, updates, security alerts, and support and administrative messages. You may opt-out of our marketing communications as described in the Opt-out of marketing section below.

  11. To analyze our performance and marketing activities;

  12. To create aggregated statistical data and other aggregated and/or inferred information, which we or our business partners may use to provide and improve our respective services. Including to analyze and improve the Service and our business.  As part of these activities, we may create aggregated, de-identified or other anonymous data from personal information we collect.  We make personal information into anonymous data by removing information that makes the data personally identifiable to you.  We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Service and promote our business.

  13. To provide you with professional or technical assistance, only upon your request;

  14. To provide support for the Service, and respond to your requests, questions and feedback.

  15. To enhance our data security and fraud prevention capabilities; and

  16. To comply with any applicable laws and regulations and legal process, such as to respond to subpoenas or requests from government authorities;

  17. To protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);

  18. To audit our internal processes for compliance with legal and contractual requirements and internal policies;

  19. To enforce the terms and conditions that govern the Service; and

  20. To prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.

We use your Personal Information for the purposes set out in Section 3 where:

  1. Our use of your Personal Information is necessary to perform a contract or to take steps to enter into a contract with you (e.g. to provide you with your login information, to provide you with our customer assistance and technical support);

  2. Our use of your Personal Information is necessary to comply with a relevant legal or regulatory obligation that we have; or

  3. Our use of your Personal Information is necessary to support legitimate interests and business purposes (for example, to maintain and improve our Services and the effectiveness of KochPro by identifying technical issues), provided it is conducted in a way that is proportionate and that respects your privacy rights.

 

4. How we share your ‘Personal Information’

We may share your personal information with the following parties and others (or otherwise allow them access to it) as otherwise described in this Privacy Policy in the following manners and instances or at the time  of collection:

 

  1. Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.

  2. Service providers. Companies and individuals that provide services on our behalf or help us operate the Service or our business (such as information technology, hosting, customer relationship management and support, payment processing, email delivery, shipping, advertising, marketing, and website analytics).

  3. Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, where necessary in the course of the professional services that they render to us.

  4. Third Party Service Providers:  KochPro has partnered with several service providers, whose services and solutions complement, facilitate and enhance our own. These include hosting and server co-location services, communications and content delivery networks (CDNs), data and cyber security services, billing and payment processing services, domain name registrars, shipping, fraud detection and prevention services, web analytics, e-mail distribution and monitoring services, session recording and remote access services, performance measurement, data optimization and marketing services, content providers, and our legal and financial advisors (collectively, “Third Party Service Provider(s)”). 

KochPro may share the following categories of Personal Information with Third Party Service Providers for a business purpose:

  • identifiers, including name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, or other similar identifiers.

  • commercial Personal Information, for example Personal Information regarding products or services purchased, obtained, or considered.

 

We may share the Personal Information of our Users and Users-of-Users with various third parties, including certain service providers and law enforcement officials.

The Personal Information may be shared solely in accordance with this policy.

 

4.1. Law Enforcement, Legal Requests and Duties: KochPro may disclose or otherwise allow access to any categories of your Personal Information described in this Privacy Policy pursuant to a legal request, such as a subpoena, legal proceedings, search warrant or court order, or in compliance with applicable laws, if we have a good faith belief that the law requires us to do so, with or without notice to you.

 

4.2. Protecting Rights and Safety:  KochPro may share any categories of your Personal Information described in this Privacy Policy if we believe in good faith that this will help protect the rights, property or personal safety of KochPro, any of our Users, any Users-of-Users, or any member of the general public, with or without notice to you.

 

4.3. KochPro Subsidiaries and Affiliated Companies: We may share your Personal Information internally within our family of companies, for the purposes described in this Privacy Policy. For example, we may share your Personal Information with Wix.com Inc., our US-based subsidiary, in the course of facilitating and providing you (and your Users-of-Users) with our Services. Sharing Personal Information by KochPro subsidiaries and affiliated companies in the European Union, Israel, and Austria with KochPro’s subsidiaries located outside these regions will only take place under an approved transfer mechanism, such as the relevant Standard Contractual Clauses.

 

In connection with a change in corporate control: In addition, should KochPro or any of its affiliates undergo any change in control, including by means of merger, acquisition or purchase of substantially all of its assets, your Personal Information may be shared with the parties involved in such event.

 

4.4. Upon Your Further Direction: The KochPro Services enable you, through different techniques, to engage and procure various third-party services, products and tools for enhancing your web links, profile, or mobile sites, including, without limitation, applications and widgets offered to you by third parties through the KochPro Website and software, eCommerce payment providers, third-party. shipping provider who may assist you with tracking your order, etc. (collectively, “Third Party Services”). If you choose to engage with such Third-Party Services, they may have access to and process Personal Information of your Users-of-Users collected through your web or mobile sites.

For example:

a) Social Media Features: Our Services may enable you to integrate certain Social Media features, widgets, and single sign on features, such as “Facebook Connect,” or “Google Sign-in” (“Social Media Features”) into your web, software or mobile sites. These Social Media Features may collect certain Personal Information from your Users-of-Users such as identifiers, including name, alias, unique personal identifier, online identifier, internet protocol address, email address, or other similar identifiers. Social Media Features are hosted either by a third party or directly on our Services.

 

Please note that in the example listed above in this Section 4.4, KochPro merely acts as an intermediary platform allowing you to procure the services of such Third-Party Services (including, but not limited to, Third Party Developers, Third Party Apps and Social Media Features) with which you are interacting directly, and at your discretion. In this respect, Kochpro acts as a service provider to you, disclosing information to the Third-Party Services on your behalf. KochPro will share your Users-of-Users’ Personal Information with Third Parties Services only upon your direction or with your permission and is not, and shall not be, in any way responsible for such Third-Party Services processing of such Personal Information, or liable with respect thereto.

 

KochPro does not control and is not responsible for the actions or policies of any Third-Party Service, and your use of any Third-Party Service is at your own risk. We encourage you to review any privacy policy accompanying a Third-Party Service and ask such Third-Party Service for any clarifications you may need before deciding to install and/or use their services.

 

4.5. Business transferees. Acquiring and other relevant parties to business transactions (or potential transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Beacons or our affiliates (including, in connection with a bankruptcy or similar proceedings).

 

4.6. Merchant partners. We may share your personal information with our merchant partners and affiliate marketplaces or enable them to collect information directly via our Service. For example, we work with Shopify.com, Wix.com, Superphone.io merchants to display products for purchase on the Service; if you purchase a product, personal information will be shared with the merchant and/or Shopify, Wix, or Superphone. 4.7. Other users and the public. You may choose to make publicly visible some of the information on your profile.  If you submit a Request to a content creator, you can choose to make the Request public or private.  Any information that is not private may be associated with your profile and can be collected and used by others.  We cannot control who reads the information that you make viewable or what they may choose to do with it.

 

5. Where do we store your ‘Personal Information’?

Users’ and Users-of-Users’ Personal Information may be stored in data centers located in the United States of America and Austria. We may use other jurisdictions as necessary for the proper delivery of our Services and/or as may be required by law.

KochPro affiliates and Third-Party Service Providers that store or process your Personal Information on KochPro’s behalf are contractually committed to keep it protected and secured, in accordance with industry standards and regardless of any lesser legal requirements which may apply in their jurisdiction.

 

If you purchase a product, personal information will be stored with the merchant and/or Shopify or Wix if you purchase through TheKochPro.com or Superphone if you purchase through text. 6. Users-of-users’ ‘Personal Information’

KochPro may collect, store and process certain Personal Information of Users-of-Users (“Users-of-Users Information”), solely on our Users’ behalf and at their direction. For example, each of our Users is able to import their e-mail contacts from third-party services like Gmail, or otherwise collect and manage contacts via their User dashboard (qr.kochpross.com/user). Such contacts are then stored with Kochpro and our affiliate, on the User’s behalf.

For such purposes, KochPro serves and shall be considered as a “Processor” and not as the “Controller” (as both such capitalized terms are defined in the European Union General Data Protection Regulation (“GDPR”)) of such Users-of-Users Information.

The Users controlling and operating such User profiles shall be considered as the “Controllers” of such Users-of-Users Information and  are responsible for complying with all laws and regulations that may apply to the collection and control of such Users-of-Users Information, including all privacy and data protection laws of all relevant jurisdictions.

The Processing of the Users-of-users’ Personal Information shall take place within the territory of the European Union, Israel or a third country, territory or one or more specified sectors within that third country of which the European Commission has decided that it ensures an adequate level of protection and such processing and transfer will be in accordance to the Data Processing Addendum – Users (“DPA"). Any transfer to and Processing in a third country outside the European Union that does not ensure an adequate level of protection according to the European Commission, shall be conducted under an approved transfer mechanism, as detailed in the DPA.

You are responsible for the security, integrity and authorized usage of Personal Information about Users-of-Users’, and for obtaining consents, permissions and providing any required data subject rights and fair processing notices required for the collection and usage of such Personal Information.

KochPro cannot provide legal advice to Users or their Users-of-Users, however we do recommend that all Users publish and maintain clear and comprehensive privacy policies on their User accounts in accordance with any applicable laws and regulations, and that all Users-of-Users carefully read those policies and make sure that they understand and, to the extent required by applicable law, consent to them.

For more information on how Users-of-Users Personal Information may be handled by KochPro (which may be relevant for any specific notice you provide to and/or consent you obtain from your Users-of-Users), please see Sections 4, 12 and 13.

 

If you are a visitor, user or customer of any of our Users, please read the following: KochPro has no direct relationship with Users-of-Users whose Personal Information it processes. If you are a visitor, user or customer of any of our Users, and would like to make any requests or queries regarding your Personal Information, please contact such User(s) directly. For example, if you wish to request to access, correct, amend, or delete inaccurate Personal Information processed by KochPro on behalf of its Users, please direct your query to the relevant User (who is the “Controller” of such data). If KochPro is requested by our Users to remove any Users-of-Users’ Personal Information, we will respond to such requests in a timely manner upon verification and in accordance with applicable law (for example, thirty (30) days under the GDPR). Unless otherwise instructed by our User, we will retain their Users-of-Users’ Personal Information for the period set forth in Section 12 below.

7. Your rights in relation to your ‘Personal Information’

KochPro believes that it is important that all KochPro users have control over their Personal Information. Therefore, depending on the way you use the KochPro Services, you may have the right to request access to, receive a copy of, update, amend or delete, port certain Personal Information to another service, restrict, or object to certain uses of your Personal Information (for example, for direct marketing purposes). Further, when we rely on your consent for processing of your Personal Information (for instance, for direct marketing) you can withdraw your consent at any time, and such withdrawal will take affect from thereon.

KochPro will not charge you more if you exercise any of these rights and will continue to provide you with the same level of service.

If you are a KochPro user, you can access and correct a lot of your Personal Information directly through your account, or via online forms KochPro makes available to you (as detailed below). You can also exercise your rights by sending your request to privacy@TheKochPro.com, mailing it to KochPro, 405 Gretna Blvd., Suite 208, Gretna, LA 70053 or reaching out to our customer care department via email at support@thekochpro.com. When we receive your rights request, we may take steps to verify your identity before complying with the request to protect your privacy and security.

Before fulfilling your request, we may ask you for additional information in order to confirm your identity and for security purposes. We reserve the right to charge a fee where permitted by law (e.g. if your request is unfounded or excessive).

You have the right to file a complaint with your local supervisory authority for data protection (but we still recommend that you contact us first).

If you are a KochPro User, and you wish to receive a copy, access and/or request us to make corrections to the Personal Information that you have stored with us (either yours or your ‘Users-of-Users’), or wish to request a list of what Personal Information (if any) pertaining to you we disclosed to third parties for direct marketing purposes, mail your request to KochPro, 405 Gretna Blvd., Suite 208, Gretna, LA 70053. We will make reasonable efforts to honor your request promptly (unless we require further information from you in order to fulfil your request), subject to legal and other permissible considerations.

Please note that permanently deleting your KochPro account erases all of your Personal Information from KochPro databases. After completing this process, you can no longer use any of your KochPro Services, your account and all its data will be removed permanently, and KochPro will not be able to restore your account or retrieve your data in the future. If you contact our support channels in the future, the system will not recognize your account and support agents will not be able to locate the deleted account.

When it comes to your Personal Information you stored with us, you have the right to: access, receive a copy of, update, amend or delete your Personal Information​, enjoy data portability (in certain cases) restrict, or object to certain uses of your Personal Information, withdraw consent you’ve given us before to processing.


Just reach out to us by e-mail, mail or through our customer care team, or, when available, fill out our dedicated form.

You may also correct and/or update your Personal Information through your user account, if you have one.

You can also delete your Personal Information by deleting your entire account. We will respond to your requests within a reasonable timeframe.

 

 

If you are a user-of-user, please contact such user directly. If you are having trouble with such user and would like the assistance of the KochPro support team, please email us at Support@thekochpro.com. We will try our best to help you, however, we cannot guarantee you anything when you are a user-of-user because you are subject to the terms and conditions of such user.

KochPro users have the following rights with respect to their personal information:

  • If you have registered for an online account with us, you may review and update certain account information from your account.

  • If you purchased a Kochpro membership, you may review and update your profile information from your dashboard via qr.kochpross.com.

  • You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us.  You may continue to receive service-related and other non-marketing emails.

  • For information about cookies employed by the Service and how to control them, see our Cookie Notice.  section 8 for me information.

  • Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit.  We currently do not respond to “Do Not Track” or similar signals.  To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.

  • You have a right to Decline to provide information. Please understand that we need to collect personal information to provide certain services.  If you do not provide the information we identify as mandatory, we may not be able to provide those services.

  • In your dashboard via qr.kochpross.com options settings, you may choose to add a password on your KochPro profile as a security measure. You can change or remove the password through your dashboard.

  • You can also add your own privacy policy under the GDPR setting in your dashboard via qr.kochpross.com.

  • In your dashboard via qr.kochpross.com extra settings, you make choose to hide your KochPro profile from search engines.

  • If you choose to connect to the Service through your social media account, you may be able to use your settings in your account with that platform to limit the information we receive from it. If you revoke our ability to access information from a third-party platform, that choice will not apply to information that we have already received from that third party.

  • In your account’s privacy settings, you may choose to make certain profile information publicly visible and whether you want third parties to be able to find or contact you through the Service.

 

8. Use of cookies and other third-party technologies

We and our affiliates and Third-Party Service Providers use cookies and other similar technologies (“Cookies”) in order for us to provide our Service and ensure that it performs properly, to analyze our performance and marketing activities, and to personalize your experience.

You can learn more about how we use cookies and similar technologies and how you can exercise control over them in our Cookie Policy.

Please note that we do not change our practices in response to a “Do Not Track” signal in the HTTP header from a browser or mobile application, however, most browsers allow you to control cookies, including whether or not to accept them and how to remove them. We and certain third-party services may use cookies and similar tracking technologies throughout our services. These technologies are used mostly for stability, security, functionality, performance and advertising purposes.

 

 

9. Communications from KochPro

We may use your personal information to communicate with you the following ways:

9.1 Service and billing messages

KochPro may contact you with important information regarding our Services, or your use thereof. For example, we may send you a notice (through any of the means available to us) if a certain Service is temporarily suspended for maintenance; inform you of any policy changes or updates, reply to your support ticket or e-mail; send you reminders or warnings regarding upcoming or late payments for your current or upcoming subscriptions; forward abuse complaints regarding your User-of-user or privacy complaints; or notify you of material changes in our Services.

It is important that you are always able to receive such messages. For this reason, you are not able to opt-out of receiving such Service and Billing Messages unless you are no longer a KochPro User (which can be done by deactivating your account).

 

We may also contact you with service and billing-related messages and content. You will not be able to opt-out of receiving such messages.

9.2. Promotional messages

We may use your Personal Information to send you promotional content and messages by e-mail, text messages, notifications within our platform, marketing calls and similar forms of communication from KochPro or our partners (acting on KochPro’s behalf) through such means.

If you do not wish to receive such promotional messages or calls, you may notify KochPro any time or follow the “unsubscribe” or STOP instructions contained in the promotional communications you receive.

 

10.  Additional Information for California residents

If you are a California resident using the Services, the California Consumer Privacy Act ("CCPA") grants you the right to request access to and deletion of the Personal Information KochPro collects about you, as well as to request that we disclose how we collect, use, and share your Personal Information. 

California residents also have a right to opt-out of the sale of their Personal Information by a business and a right not to be discriminated against for exercising any of their rights under the CCPA. 

No sale of Personal Information. KochPro does NOT sell (as such term is defined in the CCPA) your Personal Information or your customers’ (Users-of-Users) Personal Information to third parties, and KochPro has not sold Personal Information in the twelve months prior to the effective date of this Privacy Policy.

No Discrimination. KochPro does not discriminate against any User for exercising their rights under the CCPA.

 

California consumers can exercise their CCPA rights directly or through an authorized agent by signing in to their registered KochPro account at TheKochPro.com and following the instructions outlined below. Please note: in order to protect Users’ accounts and Personal Information and safeguard Users’ privacy rights, we verify Users’ deletion and access requests, and to that extent, we may ask you for additional information or documentation (depending on the case), such as account related information, and, in some cases, billing information used to purchase paid Services, and a copy of documents that can assist with verifying your identity. 

Such identification documentation (if requested) will be used only for verification purposes and we will delete it after your request is processed.


The following instructions apply to Personal Information we may collect from California residents on or through our Services.

Right to Know: If you want to exercise your right to know or receive a copy or access the Personal Information that you have stored with us, please submit a request to access your Personal Information through this web form or by submitting a request by email to privacy@thekochpro.com, or by mailing your request to KochPro, 405 Gretna Blvd., Suite 208, Gretna, LA 70053.

 
Right to Deletion: If you want to exercise your right to request deletion of any of your Personal Information that you have stored with us, please submit a request to delete all your Personal Information (including information accessible via your User account and any other Personal Information we hold about you) through this web form, by submitting a request by email to privacy@thekocpro.com, or by mailing your request to Wix.com, to KochPro, 405 Gretna Blvd., Suite 208, Gretna, LA 70053.

 

Once we receive and verify your consumer request, we will delete your personal information from our records unless an exception applies. We will make reasonable efforts to honor your request promptly and consistent with requirements under applicable law.

 

Please note that permanently deleting your KochPro account erases all of your Personal Information from KochPro's databases. After completing this process, you can no longer use any of your KochPro Services, your account, and all its data will be removed permanently, and KochPro will not be able to restore your account or retrieve your data in the future. Additionally, if you contact our support channels in the future, the system will not recognize your account, and support agents will not be able to locate the deleted account.


If you cannot access your KochPro account or if you wish to exercise your CCPA rights through an authorized agent operating on your behalf, you, or your authorized agent (as applicable) may send a request to privacy@TheKochPro.com or reach out to our customer care department, including by requesting a callback from a customer care expert. To process your request, in order to protect Users’ accounts and Personal Information, we may ask you or your authorized agent for the verifying information detailed above, which may vary according to the circumstances of your request. Authorized agents will also need to provide KochPro with a copy of the consumer’s signed authorization designating them as their agent.

 

KochPro does NOT sell (as such term is defined in the CCPA) your Personal Information or your customers’ Personal Information (Users-of-Users) to third parties.

 

11. Questions and complaints

If you have any questions or concerns about our collection, use or disclosure of Personal Information, or if you believe that we have not complied with this Privacy Policy or applicable data protection laws, please contact us – our details are set out at the end of this Privacy Policy.

Our Data Protection Officer team will investigate the complaint and determine whether a breach has occurred and what action, if any, to take. We take every privacy complaint seriously and will make all reasonable efforts to resolve your complaint promptly and in accordance with applicable law.  

You can file a complaint with your local supervisory authority for data protection at any time, however we recommend that you contact us first so we can try to resolve it.

12. Data retention

We may retain your Personal Information (as well as your Users-of-Users’ Personal Information) for as long as your User Account is active, as indicated in this Privacy Policy, or as otherwise needed to provide you with our Services.

We may continue to retain your Personal Information after you deactivate your User Account and/or cease to use any particular Services, as reasonably necessary to comply with our legal obligations, to resolve disputes regarding our Users or their Users-of-Users, prevent fraud and abuse, enforce our agreements and/or protect our legitimate interests.

We maintain a data retention policy which we apply to Personal Information in our care.

 

We may keep your Personal Information for as long as your account is active, and longer as needed (for example, if we are legally obligated to keep it longer, or need it to protect our interests).

 

13. Security

KochPro has implemented security measures designed to protect the Personal Information you share with us, including physical, electronic and procedural measures. Among other things, we offer HTTPS secure access to most areas on our Services; the transmission of sensitive payment information (such as a credit card number) through our designated purchase forms is protected by an industry standard SSL/TLS encrypted connection; and we regularly maintain a PCI DSS (Payment Card Industry Data Security Standards) certification. We also regularly monitor our systems for possible vulnerabilities and attacks, and regularly seek new ways and Third-Party Services for further enhancing the security of our Services and protection of our Visitors’ and Users’ privacy.

Regardless of the measures and efforts taken by KochPro, we cannot and do not guarantee the absolute protection and security of your Personal Information, your Users-of-Users’ Personal Information or any other information you upload, publish or otherwise share with KochPro or anyone else. We encourage you to set strong passwords for your User Account and User profile and avoid providing us or anyone with any sensitive Personal Information of which you believe its disclosure could cause you substantial or irreparable harm.

 

Furthermore, because certain areas on our Services are less secure than others (for example, if you set your Support forum ticket to be “Public” instead of “Private”, if you browse to a non-SSL page), if you select for your KochPro profile to be public (visible to search engines) or since e-mail and instant messaging are not recognized as secure forms of communications, we request and encourage you not to share any Personal Information on any of these areas or via any of these methods.

KochPro values the security of our customers' Personal Information, and we do everything in our power to protect it. 

 

However, as we can’t guarantee absolute protection – we encourage you to be careful, set a strong password for your account, and avoid submitting any sensitive information which, if exposed, could cause you major harm.

 

 

14. Third-party websites

The Service may contain links to websites, mobile applications, and other online services operated by third parties. We are not responsible for such websites’ or services’ privacy practices. We encourage you to be aware when you leave our Services and to read the privacy statements of each and every website and service you visit before providing your Personal Information. This Privacy Policy does not apply to such linked third-party websites and services.

 

These links are not an endorsement of, or representation that we are affiliated with, any third party.  In addition, our content may be included on web pages or in mobile applications or other online services that are not associated with us. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions.

 

 

15.  User Content

Please be aware that any Personal Information you provide in any such areas may be read, collected, and used by others who access them. To request removal of your Personal Information, please delete if from your account or feel free to contact us here. In some cases, we may not be able to remove your Personal Information from such areas. For example, if you use a third-party application (e.g., link Facebook social plugin application to your profile), you must login into such application or contact its provider if you want to remove the Personal Information you posted on that platform. 

In any event, we advise against posting any Personal Information (via any means) you don’t wish to publicize.

 

If you upload any user content to your User Account or post it on your User profile and provide it in any other way as part of the use of any Service, you do so at your own risk.

We have put adequate security measures in place to protect your Personal Information.  However, we cannot control the actions of other Users or members of the public who may access your User Content, and are not responsible for the circumvention of any privacy settings or security measures you or we may have placed on your User profile (including, for instance, password-protected areas on your User profile). You understand and acknowledge that, even after its removal by you or us, copies of User Content may remain viewable in cached and archived pages or if any third parties (including any of your Users-of-Users) have copied or stored such User Content. To clarify, we advise against uploading or posting any information you do not wish to be public.

16. Updates and interpretation

We may update this Privacy Policy as required by applicable law, and to reflect changes to our Personal Information collection, usage and storage practices. If we make any changes that we deem as “material” (in our sole good faith discretion), we will notify you (using one of the notification methods set forth in Section 15.3 of the Terms of Use) prior to the change becoming effective. In relation to any updated Privacy Policy, we will, as required by applicable law, notify you, seek your consent and/or take any other measures. We encourage you to periodically review this page for the latest Information on our privacy practices. Unless stated otherwise, our most current Privacy Policy applies to all information that we have about you and your Users-of-Users, with respect to our Website, KochPro Software, Mobile Apps and other Services.
